General Terms and Conditions for Digital Interior Design Services, Visualisations, and Marketing Floor Plans Giulia Ganzaroli · Sole Proprietor trading under the business name Ganzaroli Interiors
§ 1 Scope
These General Terms and Conditions apply to all contracts for digital interior design services concluded between Giulia Ganzaroli and her clients.
The contracting party is Giulia Ganzaroli, sole proprietor, trading under the business name Ganzaroli Interiors.
A consumer is any natural person who enters into a legal transaction primarily for private purposes. Services are offered internationally.
§ 2 Subject Matter of the Contract
The subject matter of the contract is the provision of individual interior design planning services in digital form.
Services are provided exclusively online (e.g. by email, digital presentation, or video call).
No physical goods are delivered.
The specific scope of services is set out in the respective offer.
The scope of services owed is determined solely by the respective offer. Additional services or revision requests beyond this scope will be charged separately.
§ 3 Conclusion of Contract
The presentation of services on the website does not constitute a legally binding offer.
The client initiates contact by submitting an enquiry. On this basis, Giulia Ganzaroli provides an individual quote.
The contract is concluded upon the client's express written acceptance of the offer — typically by email or by signing the offer document.
Upon conclusion of the contract, the client will receive an order confirmation by email.
§ 4 Prices and Payment Terms
All prices are stated in euros.
A deposit of 30% of the agreed total amount is due before the project begins. The remaining balance is due in accordance with the payment terms specified in the offer.
Payment is made by invoice. Payment terms are set out in the individual offer.
Any additional costs (e.g. currency conversion fees) are borne by the client.
§ 5 Commencement of Services and Client Obligations
Project work is conditional upon receipt of the deposit in accordance with § 4(2) and the complete submission of all documents required for implementation.
Work will commence at the earliest once the conditions set out in paragraph 1 have been met and — unless express consent to early commencement has been given — after the statutory withdrawal period has expired.
The project start date is as individually agreed in the offer, but no earlier than once the conditions set out in paragraph 1 have been fulfilled.
Required documents include in particular:

the completed client questionnaire

floor plans
-
measurements
-
photographs
-
any other project-related files and information
If documents or essential information are incomplete or contradictory, work will not begin until all information required for the planning has been clarified and fully provided.
The planning is based solely on the information and documents provided by the client. No liability is accepted for their accuracy, completeness, or dimensional correctness.
Delays resulting from incomplete, incorrect, or late submissions by the client will lead to a corresponding postponement of the project start and overall timeline.
§ 6 Right of Withdrawal
Consumers are generally entitled to a statutory right of withdrawal.
The withdrawal period is 14 days from the date the contract is concluded.
The right of withdrawal expires early in the case of services if the service has been fully performed and the client has previously given express consent for the service to begin before the withdrawal period has expired, and has acknowledged that their right of withdrawal will be lost upon full performance of the contract.
Express consent is given as part of the project questionnaire.
The separate withdrawal notice forms part of the contract.
§ 7 Scope of Services and Liability
The services constitute a creative planning service based on the information provided by the client.
Upon delivery of the final plans, the contractually owed service is deemed to have been rendered.
The planning does not include in particular:

structural, constructional, or building code assessments

electrical, plumbing, or other technical engineering
-
construction supervision or project management
-
review of public law regulations
The assessment of structural conditions (e.g. load-bearing capacity of walls or ceilings, fixings) does not form part of the service and is the responsibility of the client and the relevant specialist contractors.
The ordering, procurement, and practical implementation of recommended products and measures are the sole responsibility of the client.
Prices, delivery times, and availability of products recommended as part of the planning are subject to change at any time. There is no entitlement to the procurement or delivery of specific products, and no guarantee is given as to their continued availability or currency.
Individual health considerations (e.g. allergies or intolerances) are taken into account solely on the basis of information expressly communicated by the client.
No guarantee is given as to any particular outcome, budget, or specific economic, functional, or aesthetic result.
The liability of Giulia Ganzaroli is excluded to the extent permitted by law. This does not apply to damages resulting from intentional or grossly negligent breach of duty, or to damages arising from injury to life, body, or health.
§ 8 Revision Round
One revision round is included in the agreed service, unless otherwise specified in the individual offer. The revision round covers adjustments and additions within the existing planning concept.
This includes in particular:

fine-tuning of furniture arrangements
-
adjustments to individual elements
-
replacement of individual products
-
refinement of details
Not included are:
-
the development of an entirely new design concept
-
fundamental changes of style
-
conceptual redesigns
-
changes arising from requirements that have been altered after the fact
Any changes requested beyond the scope described above will be treated as additional services and charged accordingly.
The revision round must be requested within 14 days of the plans being submitted.
§ 9 Copyright and Usage Rights
All concepts, designs, visualisations, and documents created as part of the service are protected by copyright.
Upon conclusion of the contract, the client is granted a simple, non-transferable right of use for the purposes of the respective project. This includes private use as well as the marketing of the relevant property (e.g. sale, rental, or commercial presentation).
Any further disclosure to third parties or other commercial use is not permitted without express written consent.
Giulia Ganzaroli is entitled to use completed projects for reference purposes, provided there are no legitimate interests of the client that would preclude this.
§ 10 Applicable Law and Language
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Mandatory consumer protection provisions of the country in which the client is habitually resident remain unaffected.
If these Terms and Conditions are provided in multiple language versions, the German version shall prevail in the event of discrepancies or questions of interpretation.
