Terms and Conditions

for digital interior design services

§1 Scope of Application

(1) These Terms and Conditions apply to all contracts for digital interior design services concluded by consumers via the online shop.

(2) The contractual partner is Giulia Ganzaroli, sole proprietor, trading under the business name “Ganzaroli Interiors”.

(3) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

(4) The services are offered internationally.

§2 Subject Matter of the Contract

(1) The subject of the contract is the provision of individual interior design planning services in digital form.

(2) The services are provided exclusively online (e.g. via email, digital presentations, or video calls).

(3) No physical goods are delivered and no standardized digital download products are sold.

(4) The specific service description is determined by the selected package.

(5) The scope of services owed is exclusively defined by the respective package description. Additional services or changes are subject to additional charges.

(6) If multiple spatial areas are to be planned, a separate package must be booked for each room or functional area. Open-plan layouts (e.g. living/dining/kitchen) are considered multiple rooms if they can be used separately. Multi-functional spaces must be booked accordingly.

§3 Conclusion of Contract

(1) The presentation of services in the online shop does not constitute a legally binding offer.

(2) By completing the payment process, the customer submits a binding offer to conclude a contract.

(3) The contract is concluded upon successful completion of the payment process. Upon payment, the selected package is purchased in a binding manner.

(4) The customer will receive an order confirmation via email.

§4 Prices and Payment Terms

(1) All prices are stated in euros.

(2) Payment is due immediately upon conclusion of the contract.

(3) Payment processing is carried out via the payment service providers offered in the online shop.

(4) Any additional fees (e.g. currency conversion fees or payment provider charges) shall be borne by the customer.

§5 Start of Services and Customer Obligations

(1) Project work begins only after payment has been received and all required materials have been provided in full.

(2) Work will commence at the earliest once the conditions in paragraph (1) are met and — unless the customer has expressly agreed to early performance — after the statutory withdrawal period has expired.

(3) The exact project start is determined individually, taking into account current workload and standard business operations.

(4) Required materials include in particular:

  • completed client questionnaire

  • floor plans

  • measurements

  • photographs

  • and other relevant project-related files and information

(5) If materials or essential information are incomplete or inconsistent, work will only begin once all necessary information has been clarified and provided.

(6) The planning is based exclusively on the information and materials provided by the customer. No liability is assumed for their accuracy, completeness, or dimensional correctness.

(7) Delays caused by incomplete, incorrect, or late submission of information by the customer will result in a corresponding delay in project start and processing time.

§6 Right of Withdrawal

(1) Consumers generally have a statutory right of withdrawal.

(2) The withdrawal period is 14 days from the conclusion of the contract.

(3) In the case of services, the right of withdrawal expires prematurely if the service has been fully performed and the customer has expressly agreed that performance may begin before the end of the withdrawal period and has acknowledged that they lose their right of withdrawal upon full performance.

(4) This explicit consent is obtained as part of the project questionnaire.

(5) The separate withdrawal policy is part of the ordering process.

§7 Scope of Services and Liability

(1) The services constitute a creative planning service based on the information provided by the customer.

(2) The contractual service is deemed fulfilled upon delivery of the final design.

(3) The services do not include in particular:

  • structural, engineering, or legal compliance checks

  • electrical, plumbing, or other technical planning

  • construction supervision or project management

  • verification of public law regulations

(4) The verification of structural conditions (e.g. load-bearing capacity of walls, ceilings, or mounting options) is not part of the service and is the responsibility of the customer or executing professionals.

(5) Ordering, procurement, and implementation of recommended products and measures are the sole responsibility of the customer.

(6) Prices, delivery times, and availability of recommended products may change at any time. No guarantee is given regarding availability or procurement.

(7) Consideration of individual health conditions (e.g. allergies or intolerances) is based solely on information explicitly provided by the customer.

(8) No guarantee of success, budget compliance, or specific economic, functional, or aesthetic outcome is provided.

(9) Liability of Giulia Ganzaroli is excluded to the extent permitted by law. This does not apply to damages resulting from intent or gross negligence or to damages resulting from injury to life, body, or health.

§8 Revision

One revision is included in the booked service unless otherwise specified in the respective package. The revision includes adjustments within the existing design concept, such as:

  • fine-tuning of furniture layout

  • adjustments of individual elements

  • replacement of individual items

  • optimization of details

Not included are:

  • development of a completely new concept

  • fundamental style changes

  • conceptual restructuring

  • changes based on newly introduced requirements

Additional changes beyond this scope are considered additional services and will be charged separately.

The revision must be requested within 14 days after delivery of the design.

§9 Copyright and Usage Rights

(1) All concepts, designs, visualizations, and documents created within the scope of the service are protected by copyright.

(2) The customer is granted a non-exclusive, non-transferable right of use for private purposes within the respective project.

(3) Transfer to third parties or commercial use is not permitted without explicit written consent.

(4) Giulia Ganzaroli is entitled to use completed projects for reference purposes unless legitimate customer interests conflict.

§10 Applicable Law and Language

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.

(3) If these Terms and Conditions are provided in multiple languages, the German version shall prevail in case of discrepancies or interpretation issues.
